What is the NJ Division of Alcoholic Beverage Control?
The Division of Alcoholic Beverage Control (Commonly referred to as “ABC”) is the branch of State Government that regulates the manufacture, distribution and sale of alcoholic beverages within the State of New Jersey. In 1933, the 21st Amendment to the United States Constitution gave each state the right to decide whether to allow alcoholic beverages, and, if so, set up a regulatory scheme. New Jersey was one of the first States to enact statutory regulations under what is known as the Alcoholic Beverage Control Act. This Act created what was then known as the Department of Alcoholic Beverage Control (now known as the Division of Alcoholic Beverage Control) and established the leadership position of Commissioner. Later revisions to New Jersey’s Constitution resulted in changes the the statutes and regualtions that currently control New Jersey’s Alcoholic Beverage Industry. Alcoholic Beverage Control was absorbed into and became a division of the Department of Law and Public Safety under the New Jersey Attorney General. Currently, ABC is headed by a Director, whose position requires that he oversee and enforce the regulations as they interact between private entities and the commerce of alcoholic beverages, pursuant to NJSA 33:1-11.
